These terms apply to your use of the Material Participation Log ("the Log") at hours.lebeaucpa.com, provided by LeBeau & Associates, CPAs ("the firm," "we"). By setting up your account and using the Log, you agree to them.
1. What the Log is
The Log is a record-keeping tool. It helps you record, with dates, the time you spend on a business you own, along with supporting photos and receipts, and it produces reports of those records.
The Log does not, by itself, establish that you materially participated in an activity, or that you qualify for any tax treatment. Whether you meet those tests depends on all the facts, including some the Log doesn't measure (for example, whether any other individual participated more than you). We'll evaluate that with you as part of our engagement. The IRS or a state taxing authority may question your records, and we can't guarantee any outcome.
Nothing in the Log is tax, legal, or financial advice. Advice comes from the firm through your engagement.
2. Your responsibilities
- Accuracy: enter only work you actually performed, and describe it truthfully and specifically. Record your time as close to the work as you can; entries saved more than 7 days after the work are marked as late.
- Your sign-in: keep your password, email account, and phone secure, and don't share your sign-in. Tell us right away if you think someone else has used your account.
- What you upload: upload only photos and receipts that support your entries. Don't upload other people's private information, or account numbers you don't need to show.
- Proper use: don't try to access other people's information, interfere with the Log, or use it for any other purpose.
3. Your records
- Entries, attachments, and their history can't be deleted. You can correct an entry while its tax year is open (through January 15 of the following year); the original and every change are kept, with the date and your reason.
- We keep your records for at least 7 years after the end of each tax year, as described in our Privacy Notice.
- You can create and download a report of your records at any time while your account is active. If your account is closed, contact us for a copy.
4. Privacy and security
We handle your information as described in the Material Participation Log Privacy Notice, which is part of these terms. We protect it with reasonable safeguards, but no online service can be guaranteed completely secure.
5. Availability
We provide the Log "as is" and "as available". It may sometimes be unavailable for maintenance, updates, or reasons outside our control. Don't rely on being able to reconstruct your hours later: record them promptly, and keep any records you'd normally keep.
6. Limits of responsibility
To the extent the law allows, the firm isn't responsible for losses that result from:
- inaccurate or incomplete information you enter,
- your failure to keep your sign-in secure, or
- the Log being temporarily unavailable.
Nothing in these terms limits any responsibility the firm has under our engagement letter, professional standards, or law that can't be limited by agreement.
7. Ending your use
You may stop using the Log at any time, and you can ask us to close your account. We may suspend or close access if these terms are broken, or when our engagement ends. Your records are kept for the retention period either way.
8. Changes to these terms
We may update these terms. If we do, we'll ask you to review and accept the new version the next time you sign in.
9. General
Idaho law governs these terms. If any part of them can't be enforced, the rest still applies. Questions: call us at (208) 898-0500.
